1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Bowmedia, LLC ("Company," "we," "our," or "us") regarding your use of our website https://www.elibowman.com and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

We provide personal transformation coaching, educational content, courses, and related services including:

- One-on-one coaching sessions

- Group coaching programs

- Online courses and workshops

- Mastermind programs

- In-person events

- Digital products and materials

- Proprietary assessments and tools

- Online communities and group programs

Our services focus on helping individuals identify and rewrite unconscious mental programming to achieve authentic success and purpose using neurolinguistic programming (NLP), timeline therapy, and related methodologies.

3. Eligibility and Age Requirements

You must be at least 18 years old to use our Service, or 21 years old in jurisdictions where that is the minimum legal age requirement for adulthood. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Service Delivery and Technical Requirements

Platforms and Technology

We utilize various platforms including Zoom, custom portals, Google Meet, and other technological systems to facilitate communications, programs, and offerings.

Technical Requirements

You must have access to and ability to use the required digital meeting platforms (such as Zoom) for participation in sessions and programs.

Technical Support

We do not provide technical support. You are responsible for ensuring your technology meets the requirements for participation.

Technical Difficulties

If technical difficulties occur during sessions that cannot be resolved, we will reschedule the session at no additional cost.

5. Coaching Services and Programs

Service Provision

Our coaching services range from 15-minute sessions to multi-month programs with multiple calls or visits. All services are provided for educational and personal development purposes using NLP, timeline therapy, and coaching methodologies.

No Guarantees

**WE EXPLICITLY STATE THAT WE OFFER NO GUARANTEES OR MONEY-BACK PROMISES REGARDING RESULTS, OUTCOMES, OR SPECIFIC ACHIEVEMENTS. RESULTS MAY VARY, AND SUCCESS DEPENDS ON INDIVIDUAL EFFORT AND CIRCUMSTANCES.**

Client Responsibilities

As a client, you agree to:

- Participate professionally and appropriately in all sessions

- Maintain confidentiality regarding other participants and program content

- Take full responsibility for implementing any suggested strategies

- Seek appropriate professional help if experiencing mental health crises

Cancellation and Rescheduling Policy

- All sessions must be cancelled at least 48 hours in advance

- Cancellations with less than 48 hours notice will result in forfeiture of the session

- No-shows will result in forfeiture of the session

- Missed sessions or non-participation results in no refund and forfeiture of that session from your package

Session Extensions and Additional Time

- Requests for session extensions or additional time will incur additional costs as explicitly stated

- We reserve the right to extend sessions or provide additional time at no additional fee at our sole discretion

Illness or Unavailability

If we become ill or unavailable, you will receive a request to reschedule the provided service or product.

Program Pausing

We do not have a standard pausing policy but will work with clients on an individual basis according to their specific needs.

6. Enrollment and Waiting Lists

We may from time to time have waiting lists or limited enrollment periods for certain programs. Enrollment is subject to availability and our sole discretion.

7. Payment Terms

Accepted Payment Methods

We accept multiple electronic payment methods including credit/debit cards, ACH, Zelle, and electronic checks.

Payment Plans

We do not typically offer payment plans or installments unless explicitly stated in a specific offer. However, we reserve the right to offer payment plans or installments at our discretion.

Payment Plan Defaults

If you default on a payment plan:

- You must pay the remaining balance in full before any services can be rendered

- If unable to pay the remaining balance, we will refund amounts paid up to that point

- No services will be provided until payment obligations are resolved

No Late Fees

We do not charge late fees or interest on overdue payments.

No Free Trials

We do not offer free trials or consultations.

8. Refund Policy

**NO REFUNDS:** We do not offer refunds for any services, programs, or products, except in the specific circumstance of payment plan defaults as outlined above.

9. Content and Intellectual Property

Our Proprietary Content

All content, including but not limited to frameworks (Path of Purpose, Borrowed Values Program, RAS Expansion, Alignment Algorithm, Active Loop Engines), assessments, tools, methodologies, and materials are proprietary to Bowmedia, LLC and protected by intellectual property laws.

Recorded Materials

- We may from time to time provide recorded sessions, workbooks, or digital materials at our discretion

- **CLIENTS MAY NOT RECORD SESSIONS FOR PERSONAL USE OR ANY OTHER REASON WHATSOEVER**

- Unauthorized recording is strictly prohibited and may result in immediate termination

Client-Created Content

**ALL CONTENT CREATED BY CLIENTS WITHIN OUR PROGRAMS BECOMES THE PROPERTY OF BOWMEDIA, LLC.** This includes but is not limited to testimonials, case studies, insights, and any materials developed during participation.

Marketing Use

We reserve the right to use client testimonials and case studies in our marketing materials.

10. Group Programs and Online Communities

Community Rules

Participation in group programs and online communities requires agreement to specific rules and guidelines that will be explicitly stated within each community platform. **PARTICIPATION ASSUMES ACCEPTANCE OF ALL RULES AND GUIDELINES, BOTH EXPLICIT AND IMPLICIT.**

Confidentiality

All communication within group programs and communities is considered confidential to that ecosystem and may not be used or disclosed outside of it.

Contact Information

Participants may not share contact information with each other within the group or community ecosystem.

Conflict Resolution

Conflicts between participants will be handled according to fair and equitable measures as determined by us in our sole discretion.

Disruptive Behavior

Clients who become disruptive or inappropriate will be:

- Calmly asked to leave or excuse themselves

- Removed from virtual meetings at our discretion

- Physically escorted from in-person events if necessary

- Permanently banned from programs without refund

11. Professional Boundaries and Mental Health

Professional Relationship

All interactions must remain professional and appropriate. We maintain strict professional boundaries in all client relationships.

Mental Health Disclaimer

**WE ARE NOT LICENSED MENTAL HEALTH PROFESSIONALS.** Our services are for coaching and educational purposes only, not therapy or medical treatment.

Crisis Situations

**IMPORTANT:** If you are experiencing a mental health crisis or thoughts of self-harm:

- We cannot be held liable or responsible for any actions you may take that result in self-harm or harm to others

- You must seek professional help immediately from qualified mental health professionals in your local area

- We strongly encourage immediate contact with local emergency services or mental health crisis lines

Mandatory Reporting

We do not have a mandatory reporting policy within our ecosystem. However, this does not affect any mandatory reporting obligations that individuals may have based on their professional roles outside our ecosystem.

12. Certifications and Qualifications

Eli Bowman is a certified practitioner of Neurolinguistic Programming, Timeline Therapy, and Neurolinguistic Programming Coaching, certified by the American Board of Neurolinguistic Programming, with master designations in all three certifications.

13. Business Partnerships and Affiliates

We reserve the right to:

- Establish affiliate programs or referral commissions

- Partner with other coaches or service providers

- Offer joint programs or services

14. Products and Services

We offer both physical products and services. We do not maintain different terms for corporate versus individual clients.

15. Continuing Education

We do not currently offer continuing education credits or certifications but reserve the right to do so in the future.

16. Communication and Response Times

Clients may contact us for support through our website or email.

Response Times

We will respond to client communications within 2 to 5 business days.

Business Operations

We are headquartered in the Eastern Time Zone. We do not maintain explicitly stated business hours or availability windows.

17. Team Structure

While currently operated by Eli Bowman, we plan to expand to a team structure and reserve the right to assign qualified team members to provide services.

18. International Clients and Jurisdiction

International Service

We work with clients internationally. All applicable laws of each jurisdiction will apply.

Liability Limitation

**BOWMEDIA, LLC RESERVES MINIMUM LIABILITY IN ALL JURISDICTIONS TO THE MAXIMUM EXTENT PERMITTED BY LAW.**

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles, except where local laws require otherwise.

19. Data and Privacy

Data Retention

We will securely retain client data for internal purposes and use only, in accordance with our Privacy Policy.

Confidentiality

We maintain confidentiality regarding individual coaching sessions, except where disclosure is required by law or necessary to prevent harm.

20. Risk Management and Liability

High-Value Services

Our most valuable service is one-on-one NLP breakthrough sessions. All liability limitations apply regardless of service value.

Primary Business Risk

**IMPORTANT NOTICE:** Our biggest business risk involves potential litigation where clients may assume we provided guarantees of results. **WE EXPLICITLY STATE THAT WE OFFER NO GUARANTEES OF RESULTS WHATSOEVER.**

Professional Liability Insurance

We do not currently maintain professional liability insurance.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- **NO GUARANTEES:** WE MAKE NO GUARANTEES REGARDING RESULTS, OUTCOMES, OR SPECIFIC ACHIEVEMENTS

- **TOTAL LIABILITY:** OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE

- **EXCLUDED DAMAGES:** WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

- **BUSINESS LOSSES:** WE SHALL NOT BE LIABLE FOR LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES

- **SELF-HARM:** WE CANNOT BE HELD LIABLE FOR ANY ACTIONS RESULTING IN SELF-HARM OR HARM TO OTHERS

22. Indemnification

You agree to indemnify and hold harmless Bowmedia, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

- Your use of the Service

- Violation of these Terms

- Any actions you take based on our services

- Any harm to yourself or others

23. Termination

Immediate Termination

We may terminate your access immediately for:

- Violation of these Terms

- Disruptive or inappropriate behavior

- Non-payment of fees

- Any reason at our sole discretion

No Refunds Upon Termination

Termination does not entitle you to any refunds.

24. Modifications and Updates

We reserve the right to modify these Terms at any time. Continued use after modifications constitutes acceptance of the new Terms.
